One Saturday morning he was returning his lorry to the work yard when the manager asked James to drive a forklift in the yard to move a metal pipe. James drove the forklift and moved the pipe he dismounted from the forklift to ask the manger were the metal pipe should be deposited. As James was standing beside the forklift truck the metal pipe unfortunately fell off the forks of the forklift and struck his legs.
Unfortunately, James suffered a very severe injury to his leg which resulted in the amputation of the lower part of the leg. He spent many days in hospital. A friend and colleague of James recommended that he contact us to instigate a personal injury claim.
Emmet J Kelly & Company solicitors – experts in Accidents at Work Banbridge
Emmet J Kelly & Company solicitors commenced a claim against the employer. Liability was accepted but the insurers for the employer alleged contributory negligence basically that he should have been more careful when moving the forklift truck. Contributory negligence is when the injured person is partly to blame for their own accident. We issued High Court proceedings against the employer. We had James examined by Orthopaedic Surgeon, Plastic Surgeon and a Prosthetic leg expert. The medical report confirmed that James would have difficulty returning to his former employment as a lorry driver due to the amputation of his lower leg. The case was listed for hearing, but negotiations were entered with the insurers for the employer.
The case settled in the sum of £1,000,000 million pounds. This settlement figure came as a great relief to James and his wife and family as it give him financial security for the rest of his life.
